TSA Discriminates, But Inefficiently - Risking Lives and Wasting Resources, Says Law Prof
The operating procedures manual accidentally posted on the Internet by the TSA shows that the agency is now using both ethnicity and religion, at least indirectly, as factors in screening. The manual instructs screeners to automatically select, for secondary screening, all citizens of 12 named countries. Aside from 2 Communist nations, all of the others have large Muslim populations, including 8 which are at least 90% Muslim, and most are Arabic. This hardly seems to be just a coincidence.
But since all travelers from these countries are automatically singled out for secondary screening, the system fails to distinguish between toddlers or elderly women from the suspect country on the one hand, and young males from these same countries on the other. Thus elderly women, young children, and others from these countries very unlikely to pose any threat are automatically singled out simply because of their country of origin; virtually all Muslim and most Arabic.
This system also would not have singled out Umar Farouk Abdulmutalib for secondary screening, even though he is a young male from the 4th most populous Muslim country, suspiciously used cash to buy a one-way ticket, was on a watch list, and chose a seat known to make the aircraft especially vulnerable to explosions.
This is important because explosive materials, and bombs without metallic detonators, do not set off the metal detectors all passengers are required to walk though, and the more thorough secondary screening techniques which may be able to detect them -- e.g., using whole-body imaging scanners, "puffer" bomb-detection machines, or a lengthy hand pat down -- are either too expensive and/or take too much time to be used on the majority of passengers.
Thus logic, and the mathematics of testing and inspections, dictates that the only efficient method is to largely single out for secondary inspection those passengers most likely to be terrorists, and not to select fliers for the more thorough secondary inspection completely at random as the TSA now claims it does.
One way to help identify passengers who are substantially more likely to be terrorists is to utilize, in combination with other recognized signs, factors like nationality, gender, and age -- and possibly even religion and ethnicity -- in selecting passengers for secondary screening. Both the Supreme Court and the Justice Department have indicated this is constitutional, provided only that no single factor is decisive -- as it unfortunately is under the current TSA system.
Increasing the probability that those singled out for secondary screening are terrorists by considering ethnicity and/or religion, as well as gender, age, how, when and where the ticket was purchased, the demeanor and clothing of the passenger, etc., is the only logical way to make secondary screening effective and efficient, and capable of stopping terrorists without unreasonably delaying the traveling public or requiring enormous expense for new equipment and TSA screeners.
While some have suggested that behavioral analysis -- a technique pioneered Israel -- is preferable, it seems unlikely that this would work efficiently in the U.S. with our current TSA screeners and huge number of passengers. Moreover, news reports suggest that Israel does in fact use some profiling techniques, logically giving more attention and scrutiny to young Arab males than to elderly Asian females or Jewish-American children.
"We readily accept the proposition that persons buying one-way tickets for cash, or those apparently wearing more clothing than necessary, should be subject to greater scrutiny, even though only a tiny minority may be terrorists, and the predictive effectiveness of these factors may be somewhat limited. It may be time to do the same for religion, ethnicity, gender and age, which may be at least as effective as predictors. Let's stop giving young Muslim males no greater scrutiny than elderly Asian women, just because it seems politically correct," says Banzhaf.

Wintry Weather Tightens Grip On Midwest
Clare County Council said that seven road gritting crews have been covering 580 kms of road network during the Christmas period. Treated roads include all national, primary and secondary routes, as well as heavily trafficked regional roads. The Council said it hoped to replenish salt supplies later this evening.
According to Mayor of Clare Councillor Tony Mulcahy (available for interview on 086-2436345): “I wish to compliment the outdoor staff of Clare County Council for working throughout the Christmas period in often extremely difficult circumstances to ensure that as many roads as possible were salted and gritted. Motorists should keep to gritted routes where possible.”
Meanwhile, the Mayor has called on neighbours, family and friends of older people to ensure that the elderly, particularly those living alone, are kept warm and have sufficient food during the current period of cold weather.
Mayor Mulcahy noted that fuel poverty affected more than seven per cent of all pensioner households, and older people were sometimes reluctant to use up their electricity and fuel allowances. “Therefore, it is important that people across the County do their bit to assist elderly neighbours and family members”, he added.
Mayor Mulcahy continued, “According to figures from Age Action Ireland some 1,500 to 2,000 more people die in the winter months compared to the rest of the year, due largely to poor housing standards. The percentage of excess deaths in Ireland is 19 per cent, but it is ten per cent in Finland. These figures highlight the importance of checking on elderly relatives and neighbours to make sure that they are warm, have enough food and adequate heating.”
He added: “Older people, particularly those living in isolated areas, are more vulnerable during colder spells of weather. There are a number of simple measures that can be taken by the general public in order to reduce the risk to old people during cold and inclement weather”.
The Mayor explained, “Those who are elderly and living alone should be checked on by neighbours, morning and evening. A special check should be made on those elderly or disadvantaged who are housebound. Practical help can be given by bringing in solid fuel, ensuring the water supply is sufficient and checking that there is sufficient food in the house, including non-perishable foods. Where neighbours are concerned or worried they should contact the appropriate emergency services including the health services.”
Councillor Mulcahy referred members of the public to Age Action Ireland’s website ageaction.ie, which he said featured practical tips and advice.

These findings are based on a new report from the Pew Research Center’s Internet & American Life Project that looks at teens, mobile phones and distracted driving. The results were derived from a telephone survey of 800 teens' and parents’ use of mobile phones and 9 focus groups conducted in 4 U.S. cities between June and October 2009 with teens between the ages of 12 and 18.
“Many teens understand the risks of texting behind the wheel,” said Amanda Lenhart, Senior Research Specialist at the Internet & American Life Project and co-author of the distracted driving report, “but the desire to stay connected is so strong for teens and their parents that safety sometimes takes a backseat to staying in touch with friends and family.”
“Cell phones are often seen as devices that can make our lives more efficient, allowing us to multi-task in our idle moments,” said Mary Madden, Senior Research Specialist and co-author of the report, “and whether you’re a teenager or an adult, it’s tempting to think you can manage several different activities at once.”
For every two seconds a driver's eyes are off the road, a motorist is twice as likely to be involved in a crash, said Troy Green, national spokesman for AAA.
"Texting while driving ... requires your full attention and leaves no room for distraction," Green said. "You'd have to be foolish at best and delusional at worst to think you can send and receive text messages while operating a motor vehicle effectively and safely....
We believe that's something that should be banned."
Texting and cell phone use have been blamed for numerous deadly crashes in the past few years
A recently released study (PDF) by the VirginiaTech Transportation Institute found that truck drivers who were texting were 23 times more at risk of a "crash or near crash event" than "nondistracted driving." As per talking on a cell phone, the same study found no increased risk for truck drivers and 1.3 times the risk for car drivers. There was considerably more risk associated with dialing while driving. The institute's Richard Hanowski acknowledges that the numbers are likely to be different with car drivers. As reported by CNET's Jennifer Guevin, the study also found that "texting took a driver's focus away from the road for an average of 4.6 seconds--enough time...to travel the length of a football field at 55 mph."
Teens at biggest risk
When it comes to texting while driving, teens are a particular risk group considering that, according to Nielsen (PDF), "The average U.S. mobile teen now sends or receives an average of 2,899 text-messages per month" and apparently some of those texts are being sent and read from behind the wheel.
A 2007 study conducted by AAA and Seventeen magazine has been widely misquoted as 46 percent of teens admit to texting while driving. But what the study found is that "61 percent of teens admit to risky driving habits." Forty-six percent of that 61 percent say that they text message while driving.
This issue is in the news a bit more than usual these days because of a shocking video created by a police department in the UK. It depicts a teenage girl texting while driving followed by a terrible crash with gruesome results for her friends in her car and the family whose car she hit. Before viewing the video (scroll down) please be aware that it is graphic and very disturbing. And before forwarding it to a teenager, also be aware that many youth risk prevention specialists question the effectiveness of videos that try to use shock value to change teen behavior.

Winston-Salem, NC Car Dealer Has A Soft Spot For Ford Mustangs
Myers saved up all the money he earned working in the detail shop at his family's car dealership and started his own mobile DJ business (backed by a loan from his dad).
"He wanted that car so badly," said Frank Myers. "However, I knew that a 1965 model would be one of two things - a show car that we couldn't afford or a money pit. So I was able to convince him to get a red convertible 1985 model Mustang instead."
Myers wasn't the first and won't be the last teen smitten with Mustang. According to a survey by TRU (Teenage Research Unlimited), an organization specializing in youth market research, when asked which new car they would most like to buy, the majority of teens chose the Ford Mustang.
The "cool" factor of the Ford Mustang and the strong emotional response the vehicle evokes has been attracting people of all ages to the iconic muscle car ever since the first vehicle debuted at the World's Fair in New York in 1964. Today, one of out of every two sports cars sold in America is a Mustang.
"The Mustang is a part of Americana; it is part of our culture and who we are," said Robert Parker, Ford car marketing manager. "It's the kind of car that makes you feel different when you're driving it, whether you're a teenager or not."
Fritz Wilke, Ford Mustang brand manager, says he believes the Mustang ranks highly among teenagers because of its iconic status and because it's attainable.
"Mustang starts out at a price point that is within a teen's reach," he said, citing that some models are priced below $20,000. "It's a little more realistic than other much more expensive sports cars."

"In almost all instances, the Mustang is used as a metaphor for power, performance and coolness," said Parker. "Whoever's driving it has a unique personality that sets them apart from the crowd."
Another reason for teens' fascination with the Mustang may be the fact that it's an accessory-friendly vehicle. Teens, among others, love to customize their cars. In fact, Mustang leads the nearly $1 billion aftermarket parts and accessories industry as the most personalized vehicle of all time.
Like Myers however, most teens are unable to buy a vehicle without financial help from their parents. J.D. Power and Associates estimates that only 1.2 percent of new car buyers are under the age of 21. Helping some parents tip the scale in favor of the Ford Mustang are the quality and safety accolades the vehicle has earned.
Last year, Mustang came out on top in three major consumer surveys sponsored by J.D. Power & Associates - the Initial Quality Study (IQS), the Automotive Performance, Execution and Layout (APEAL) Study, and the Vehicle Dependability Study (VDS). In addition, the 2008 Mustang convertible became the first sports car and the first convertible to earn the highest possible safety ratings in new car tests performed by the U.S. government.

Mustang sales hit an astounding 419,000 in its first 12 months on the market and topped the 1-million mark in the first two years, shattering the sales records of any single model in the history of the automobile.
Ford built its 9 millionth Mustang this year, and the company is commemorating another important milestone in pony car history with a special 45th anniversary edition for the 2009 model year.

Ocean Freight Rates Are On The Rise!
Effectively negotiating ocean freight is not so simple and depends on knowing a fair amount of detail. Will you have many “one-time” shipments, or more a repetitive business with each shipper? How much product are you shipping at one time, or if repetitive, each shipment? If repetitive, how often? The answers to these questions also determine if you want to use a freight forwarder or negotiate directly with the ocean carriers.
Door to door transit time is also a huge consideration. Will you ship to a major or “gateway” port and then truck to multiple distribution centers? Or will it all go to one DC? If you are planning on moving the containers intact to an inland DC, some difficulty may arise depending on the ocean carrier, and rail charges can be quite high. A forwarder (or the customs broker) can often manage the container delivery trucking to and from the port much better than a carrier (if the carrier even would). Otherwise you must arrange the trucking.
There are quite a few charges that may be a part of the total ocean / delivery transport costs on a typical import shipment. Some may be negotiable with the carrier / forwarder (given sufficient volume and frequency) and if you understand how ocean freight rates are calculated.

GM Set to Launch Money-Back Guarantee
The initiative - while unorthodox for an automaker - is nothing new for Frank Myers Auto. They started their “100% Iron-Clad Money Back Guarantee” back in 2007 and covers all Certified Pre-Owned vehicles...regardless of the make or model. GM’s program will only cover 2009 and 2010 model-year cars from GM's surviving brands, Chevrolet, Cadillac, Buick and GMC. He said: “The airline claimed that low yield factors had determined their decision to end the service. However, the service carried 30,000 passengers last winter alone. Furthermore, the number of persons using the service has dramatically increased in recent weeks. One flight this weekend, for example, was operating at full capacity. Much of these increases can be attributed to the introduction of pre-clearance facilities at Shannon and the airline’s decision to lower its fares.”
“Aer Lingus’s announcement that it will not be utilising the US pre-clearance facilities until mid-2010 at the earliest, along with the imminent withdrawal of Delta’s long standing service and ongoing doubts over the future of Aer Lingus’s Shannon to New York service have completely undermined efforts at Shannon Airport to develop new business. The opportunities presented to airlines by the presence of the pre-clearance facilities are numerous but appear to be having little impact on business growth at the airport at present”, commented the Mayor.
Councillor McLoughlin suggested that the Shannon Airport Authority should introduce an additional landing charge incentive scheme in a bid to boost transatlantic traffic and attract new operators.
He continued: “Evidence from around the world indicates that incentive schemes for airlines planning to operate new long haul routes are very successful and generate significant benefits for the airports in question. The Shannon Airport Authority, in conjunction with the Dublin Airport Authority, should explore such options as a 5-Year incentive scheme which could offer free landing and parking charges for the first 3 years, as well as 75% and 50% discounts for the following 2 years respectively. Another possibility would be to offer 100%, 75%, 50%, 25% and 15% discounts respectively on landing and parking charges.”
“If Shannon Airport is to ever be afforded independent status then it must be given a free hand in matters such as its own marketing strategies. If this does not happen then I fear that Shannon Airport’s transatlantic business will continue to decline”, concluded Mayor McLoughlin.

Twin hose single pump added to Merridale range
Users select fuel delivery speed by choice of hose and nozzle. A 3/4” slim-line nozzle provides a lower fuel delivery speed of 50 or 70 LPM for use on smaller vehicles, whereas the use of a 1” nozzle will allow large vehicle users to benefit from a higher fuel delivery speed of 90 to 150 LPM.
The unit is designed to operate only one nozzle at any time. The single grade unit can feature a built in fuel management system and tank gauge, if required.
